OVERVIEW
Welcome to Miaomada! These Terms of Service (“Terms”) set out the conditions for using our online store. 
By using our store, you agree to these Terms and to our Privacy Policy. 
Please read them carefully as they contain important information regarding your rights and obligations, including warranty disclaimers and limitations of liability.

SECTION 1 - GENERAL PROVISIONS
These Terms of Service (“Terms”) set forth the conditions for using the online store operated by Miaomada Co., Ltd. (“the Company”).
Customers (“you”) agree to these Terms by using this store.
The handling of personal information shall be governed by the Company’s separate Privacy Policy.

SECTION 2 - ACCOUNT
When registering an account, you must provide true and accurate information.
You are solely responsible for managing your ID and password. The Company shall not be liable for any damages resulting from unauthorized use, except in cases of intentional misconduct or gross negligence by the Company.

SECTION 3 - PRODUCTS, PRICES, AND DISPLAY
Product images are made to be as close as possible to the actual items, but color, texture, and other aspects may differ depending on your device and photography conditions.
Prices, stock, and specifications may change without notice. In the event of an error in display, the Company may correct such error even after receiving an order, and may cancel or request modification of the order conditions.
Purchases for resale or redistribution purposes are strictly prohibited.

SECTION 4 - ORDERS, FORMATION OF CONTRACT, AND CANCELLATIONS
A sales contract is deemed concluded when the Company accepts your order and the shipping completion notice (such as a shipping confirmation email) has been delivered to you. The automatically generated “order received” email does not constitute acceptance.
Once an order has been confirmed, it cannot be cancelled at the customer’s request.

SECTION 5 - PAYMENT
Available payment methods will be displayed on the product page or at checkout.
Any fees related to installment payments or revolving credit shall be borne by the customer in accordance with the rules of the payment provider.

SECTION 6 - SHIPPING AND DELIVERY
Shipping is available only within Japan and will be handled by Japan Post. Delivery times may be extended for remote islands or certain regions.

SECTION 7 - RETURNS, REFUNDS, AND EXCHANGES
The conditions and procedures for returns, refunds, and exchanges are specified in the separate Returns & Refund Policy.
Please note that the cooling-off system under Japanese law does not apply to online sales. Returns must follow the Company’s own return policy.

SECTION 8 - PROHIBITED ACTS
The following acts are prohibited when using this store:
(1) Violating laws or public order and morals
(2) Infringing upon the rights of the Company or third parties
(3) Unauthorized access or transmission of harmful programs
(4) Providing false information
(5) Purchases for the purpose of resale or redistribution
(6) Any other act that interferes with the operation of the store

SECTION 9 - THIRD-PARTY LINKS
This store may contain links to websites operated by third parties, including embedded functions provided by third parties. We are not responsible for examining or evaluating the content or accuracy of any such external websites. If you choose to access a third-party website, you do so at your own risk.
The Company shall not be liable for any damages arising from your use of or reliance on any third-party websites, products, services, or content. Please review the applicable policies and terms of such third parties before engaging in any transaction with them.

SECTION 10 - RELATIONSHIP WITH SHOPIFY
Miaomada is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Miaomada. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Miaomada, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Miaomada. 

SECTION 11 - PRIVACY POLICY
All personal information collected through this store is handled in accordance with our Privacy Policy, which can be viewed here. Some information may also be subject to Shopify’s Privacy Policy, which can be viewed here. By using this store, you acknowledge that you have read and agreed to these policies.
Because this store is hosted on Shopify, Shopify collects and processes certain information about your access and use of the store in order to provide and improve its services. Information you submit may be transmitted to and shared with Shopify, as well as with third-party service providers (including those located outside of Japan), as necessary to provide the services to you.

SECTION 12 - DISCLAIMER OF WARRANTIES
Except as required by law, the Company makes no express or implied warranties regarding the suitability or usefulness of its products.
However, this does not apply in cases of intentional misconduct or gross negligence by the Company.

SECTION 13 - LIMITATION OF LIABILITY
In cases where the Company is liable for damages to a customer, liability shall be limited to direct and actual damages that normally arise, and only up to the amount of the purchase price of the relevant product (excluding shipping and handling fees), except in cases of intentional misconduct or gross negligence.

SECTION 14 - USE OF EXTERNAL SERVICES
When using third-party services such as payment providers, the terms and policies of such providers shall apply.

SECTION 15 - USE BY MINORS
Purchases by minors require the consent of a legal guardian. The Company may refuse cancellation of a purchase made by a minor without such consent.

SECTION 16 - EXCLUSION OF ANTISOCIAL FORCES
If a customer is found to be, or involved with, antisocial forces, the Company may suspend or terminate transactions without prior notice.

SECTION 17 - SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

SECTION 18 - AMENDMENTS TO THE TERMS
The Company may revise these Terms as necessary. Revised Terms shall become effective when posted on the store or on the effective date separately designated by the Company.
Important changes will be announced in advance through reasonable means.

SECTION 19 - GOVERNING LAW AND JURISDICTION
These Terms shall be governed by Japanese law. Any disputes between the customer and the Company arising in connection with this store shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
